Mark Kirkby and Pedro Fernández Sánchez publish articles in Revista de Contratos Públicos

Issue 10 of the Portuguese journal of public contracts (Revista de Contratos Públicos) includes two articles authored by SÉRVULO lawyers. Mark Kirkby, partner of the Public Law department, wrote an article about the mysteries surrounding the possibility of awarding a tender by private treaty when all proposals have been excluded in a previous tender procedure ("Os Mistérios em torno da possibilidade de escolha do ajuste direto quando em procedimento anterior todas as propostas tenham sido excluídas"). This article aims to help lawyers who are conflicted about applying these precepts and to warn the lawmaker to be cautious with regard to these matters, in the context of the transposition of the Public Procurement Directive of 2014.

In his turn Pedro Fernández Sánchez has written an article on the (exceptional) adoption of the private treaty for reasons of artistic merit when developing architecture projects ("A adopção (excepcional) do ajuste directo por motivos artísticos para elaboração de projectos de arquitectura"). The article analyses the cases in which European and Portuguese public procurement legislation allow for the direct award of architecture projects to predetermined entities for reasons of artistic or aesthetic singularity.
