Blow on the whistle or mouth on the trombone

SÉRVULO IN THE PRESS 05 Jul 2019 in Jornal Económico

“Some people say that no publicity is bad publicity, but many of us would disagree with this statement,” says Margarida Costa Gomes, SÉRVULO’s consultant and co-head of the Emplyment Law department, in an opinion article about whistleblowing for Jornal Económico.

According to this SÉRVULO consultant, in 2009, the National Data Protection Commission (CNPD) issued its “Principles Applicable to Personal Data Processing for the purpose of Internal Communication of Irregular Financial Management Acts (Ethical Guide)”. According to this guideline, the whistleblowing system is only accepted when restricted to "the areas of accounting, internal accounting controls, auditing, the fight against corruption and banking and financial crime". Only those who carry out management acts related to these areas can be reported. This usually means senior management.
