SÉRVULO PUBLICATIONS 2016 in Revista de Regulação e Concorrência (nº 27-28)

Catarina Amaro Martins, advogada da SÉRVULO, é a autora do artigo «Imputação Subjetiva: como se constrói e se prova o dolo da Pessoa Coletiva?» publicado na Revista de Regulação e Concorrência (nº 27-28).

In the scope of criminal liability of legal entities, this article aims to understand the construction and proof of their full intent. Therefore, analyzing various doctrinal contributions, we argue that the construction of the full intent of the legal person is not different at all from that of the singular individual, just an adaptation to the corporate personality. Thus, we use the collective knowledge, which will be interpreted in the light of the organizational-corporate system of the legal person. On the other hand, in the scope of the proof of full intent, this has to be factually proven, once again resorting to corporate reality. Essential in the study of this issue is judgment no. 250/2006 of the Constitutional Court.
