Pay Transparency Directive: New Rules, New Paradigm

The Pay Transparency Directive introduces new obligations for companies, both at the recruitment stage and after the conclusion of the employment contract, including enhanced requirements for the disclosure of remuneration information.

In this context, Rita Canas da Silva, partner at SÉRVULO and head of the Labour department, refers that “the Directive represents a paradigm shift, insofar as pay equality is no longer analysed solely in reactive terms and focused on tackling discriminatory situations, but now requires permanent mechanisms for monitoring, assessment and demonstration of compliance”.

João Pinto Ramos, consultant at SÉRVULO in the Labour department, adds that “the main merit of the Directive lies in strengthening the transparency of remuneration systems”. Indeed, “experience shows that one of the main difficulties in applying the principle of equal pay does not lie in the absence of rules prohibiting discriminatory practices, but rather in employees’ ability to identify pay differences that are not based on objective and gender-neutral criteria — and it is precisely in this area that the Directive may prove to be most effective”.
