“The regulation of dual-use products risks creating regulatory entropy that hampers innovation and delays the European industry compared to global competitors”

Pedro Vidigal Monteiro, partner at SÉRVULO, in the TMT department, took part in the “New Defence Economy” conference, held on 26 May and organised by PLMJ in partnership with ECO, which brought together specialists to discuss the key challenges associated with strengthening European investment in the defence sector.

In his intervention, Pedro Vidigal Monteiro addressed the applicable European regulatory framework, highlighting instruments such as the AI Act, the NIS2 Directive and the GDPR, and underlined the growing legal complexity affecting the development of technologies in this field. In particular, he pointed to the challenges posed by dual-use products and the impact of overlapping regulatory regimes on innovation.

The partner further warned of the risk of “regulatory entropy” arising from the overlap of multiple regimes, which may hinder innovation and undermine the competitiveness of the European industry in relation to global competitors.
