Extension of absence periods

Law No. 1/2022 was published today, extending the period of justified absences in the event of death of family members, as follows:

  • From 5 to 20 consecutive days, in the event of the death of a descendant or stepchild in the first degree of the direct line.
  • From 2 to 5 consecutive days, in case of death of a spouse not legally separated or of a relative or in-law up to the first degree in the direct ascending line. This extension is also applicable in case of death of a person living in a civil partnership or common economy with the employee.

The right to psychological counselling at a National Health Service establishment is also provided for in the event of the death of sons or stepchildren or of close relatives such as spouse or ascendants, which may be requested up to 5 days after the death. 

The new regime enters into force tomorrow, 4th January 2022.
