Ministerial Order no. 77/2023, of March 14th: Technical specifications for the information to be provided by Operators, under the scope of Decree-Law no. 40/2022, of June 6th

On March 14, 2023, the Ministerial Order no. 77/2023 was published in “Diário da República”, approving the technical specifications for the information to be uploaded, by companies offering public electronic communications networks, onto the platform on the coverage of fixed and mobile electronic communication networks, introduced by Decree-Law No. 40/2022.

In this sense, the Ministerial Order:

  1. Defined and described, depending on the type of service at stake, the technical specifications of the information to be uploaded in the platform by operators and the respective format to be used;
  2. Defined the deadlines within which the operators must initially upload the information:

i) 60 working days for fixed and mobile network coverage, satellite coverage and for the maritime route of submarine cables in national territory;

ii) 120 working days for the access and transport network routes;

After the initial upload, the information must be updated at the end of each quarter of each calendar year, although the operators may do so at any time, whenever it is justified.

  1. Created the obligation to report to ANACOM, with due justification, the existence of classified information (relating to critical infrastructures, the residences of holders of sovereign bodies and senior public officeholders, among others).

Note that ANACOM is the entity responsible for providing the platform, so the information should be uploaded by operators through an extranet also provided by that entity.

The Ministerial Order goes into effect on March 28, 2023.
